deCommune / Move Breathe Academy (“the Academy”, “we”, “us”), based in the Netherlands.
Student (“you”).

This Student Enrolment Agreement (the “Agreement”) governs your enrolment in the Move Breathe Academy 200-Hour Hybrid Yoga Teacher Training Program (the “Training”). It incorporates all attached Terms and Conditions (Sections 1–12 below).
By signing this Agreement and making the required €500 non-refundable enrolment deposit, you:

·       Confirm you are at least 18 years old (or have parental/guardian consent if under 18).

·       Acknowledge receipt of all pre-contractual information under EU Directive 2011/83/EU.

·       Expressly request immediate access to all online digital content and services.

·       Acknowledge that you lose your 14-day right of withdrawal for digital content once access is granted (per Article 16(m) of Directive 2011/83/EU).

·       Accept all terms herein, with no refunds after the 14-day cooling-off period (except as explicitly stated).

1.        Program Description
The Training is a fixed-duration program with a communicated fixed end date (provided prior to enrolment):

o   60 hours online: Anatomy, philosophy (delivered via third-party platform), homework assignments, and video meetings.

o   140 hours in-person: 14 consecutive days at the specified location.

o   Free access to Move Breathe Academy Private Online Community (the “Community”) until the fixed end date.
Digital content (videos, materials, etc.) is supplied immediately upon deposit confirmation and is non-tangible.

Upon full payment, the Training includes all materials such as 2 printed manuals, a notebook, and a pen, resulting in no extra material costs.

2.        Contract Start and End

o   Start: Date of signature and €500 deposit payment. Service/digital delivery begins immediately.

o   End: Fixed end date (no extensions without additional payment). Free Community access ends then.

3.        Payment Terms

o   €500 Non-Refundable Enrolment Deposit: Secures your spot; applied to total fees. Non-refundable after 14 days (or if services commence).

o   Balance: Paid in full or per agreed instalment plan before fixed end date.

o   All payments include VAT (as applicable). No hidden fees.

o   Payment Instructions: All payments must be made to the following bank account:

§  Reference: Please include your full name and enrolment reference number in the payment description.
Payments must be made in Euros (€) unless otherwise agreed. We do not accept cash payments or alternative methods without prior written approval.

o   Late/Non-Payment Consequences: If you fail to make a payment after signing the Agreement or are late with an instalment (defined as more than 7 days past the due date), the following proportionate consequences will apply, in line with EU consumer protection standards (e.g., Unfair Contract Terms Directive 93/13/EEC):

§  Late Payment Fee: A reasonable late fee of €25 may be applied per late instalment to cover administrative costs. This fee will not exceed what is proportionate under applicable law.

§  Reminder and Grace Period: We will send you a written reminder (e.g., via email) giving you at least 14 days to rectify the non-payment without additional penalties.

§  Suspension of Services: If payment is not received within the grace period, we reserve the right to suspend your access to the Training (e.g., online modules, sessions, or materials) until payment is made. No refunds or credits will be provided for suspended periods.

§  Contract Termination: Persistent non-payment (e.g., after two reminders or more than 30 days overdue) may result in termination of the Agreement. In such cases, you will remain liable for any outstanding amounts, and we may pursue recovery through lawful means, including debt collection services. Any termination will be communicated in writing, and you will forfeit access to the Training without refund for services already provided.

§  Interest: Overdue amounts may accrue interest at the statutory rate applicable in the Netherlands, not exceeding EU limits on consumer contracts.
We encourage you to contact us immediately if you anticipate payment difficulties to discuss potential arrangements.

4.        Right of Withdrawal (14-Day Cooling-Off Period)
Under EU Directive 2011/83/EU:

o   14 days from deposit date to withdraw without reason.

o   However: You expressly request immediate digital content/service start (checkbox equivalent via signature).

1.        Digital content withdrawal right is lost upon access (Article 16(m)).

2.        Proportional charge for commenced services (e.g., accessed content, attended sessions).

After 14 Days: NO REFUNDS for any reason (Training, deposit, Community access). Non-attendance does not qualify.

o   Academy-Initiated Cancellation: If we cancel the Training for reasons attributable to us (e.g., insufficient enrolment or unforeseen circumstances), you will be entitled to a full refund of all payments made. This does not include costs made for flights or other forms of transportation and accommodation prior to the training as you are responsible for your own travel insurance.

o   Refund Processing: In the event of a valid withdrawal during the 14-day cooling-off period or an academy-initiated cancellation, we will reimburse all eligible payments using the same means of payment you used for the initial transaction, unless you expressly agree otherwise. Refunds will be processed within 30 days from the date we receive your valid withdrawal notice or notify you of our cancellation. No fees will be charged for the reimbursement.

5.        In-Person Attendance & Make-Ups

o   You must attend all 14 in-person days.

o   Absences: No refunds/credits. Retake see assesement & retake policy.

o   Travel/accommodation: Your responsibility.

6.        Private Online Community Access

o   Free During Training: Until fixed end date.

o   Post-Training (€95/year):

§  Optional annual auto-renewal (cancel anytime via dashboard/email).

§  14-day 100% money-back guarantee per payment.

§  After 14 days: No refunds; access until year-end.

§  Cancellation: Stops renewals only.

7.        Intellectual Property (IP)

o   All materials (videos, workbooks, Community content) are Academy property.

o   Prohibited: Copying, sharing, distributing, or commercial use. Violations lead to immediate termination without refund.

8.        Behaviour, Conduct & Termination

o   Participate respectfully, ethically, safely (online/in-person).

o   Violations (e.g., harassment, unsafe behaviour): Immediate removal without refund.

o   Academy reserves right to terminate for any reason.

9.        Liability Waiver & Health Declaration

o   Yoga risks: You assume all risks of injury/illness from practice, pre-existing conditions, or non-compliance.

o   Declaration: I confirm I am fit to participate; no medical contraindications. Academy not liable for personal choices.

o   No warranties: Training for educational purposes; not medical/fitness advice.

10.  Data Protection, Complaints & Warranty

·       GDPR compliant (see Privacy Policy).

o   Warranty Provision: We strive to deliver the Training in accordance with the descriptions and standards outlined in this Agreement and our enrolment materials. We do not offer a money-back guarantee beyond the statutory 14-day cooling-off period or academy-initiated cancellations as described above. If you believe our services do not conform to the explicit requirements stated in this Agreement (e.g., program content, duration, or quality), you must submit a formal complaint in writing within a reasonable time after discovering the issue, providing clear evidence of the non-conformity. We will investigate and, if substantiated, offer appropriate remedies under EU consumer law (e.g., Consumer Rights Directive 2011/83/EU), such as re-performance of the non-conforming elements or a proportionate price reduction. Termination of the Agreement and full refunds are not available unless non-conformity is severe and we fail to remedy it. The burden of proving non-conformity rests with you after the initial 6 months from the start of services, in line with applicable law.

11.  Governing Law

·       Dutch law + EU consumer protections (Directive 2011/83/EU).

o   Disputes: Exclusive jurisdiction of Dutch courts.

12.  Entire Agreement & Amendments

·       This supersedes all prior discussions.

o   Amendments: Written only.

o   Severability: Invalid provisions do not affect others.
