1. Scope of Application

These Terms and Conditions apply to all contracts between Move Breathe Academy (“the Academy”, “we”, “us”) and the consumer (“student”, “you”) regarding the purchase, enrolment, and participation in the Hybrid Yoga Teacher Training Program and access to the Move Breathe Academy Private Online Community.
This agreement covers distance contracts within the meaning of Directive 2011/83/EU, including digital content and services.

2. Description of the Hybrid Yoga Teacher Training

The Hybrid Yoga Teacher Training consists of:
• 60 hours of online digital content, accessible immediately upon confirmation of payment.
• In-person training hours, held on scheduled dates at a physical location.
The training has a fixed end date, communicated clearly before enrolment.
Access to the online portion constitutes the start of service performance.

3. Access to Online Content

Upon payment, the student receives:
• Immediate access to the online training platform (digital content not supplied on a tangible medium).
• Free access to the Move Breathe Academy private online community until the fixed end date of the training.
By enrolling, the student expressly agrees to the immediate start of digital content delivery and acknowledges that once access is provided, the right of withdrawal for digital content is waived, in accordance with Article 16(m) of Directive 2011/83/EU.

4. Right of Withdrawal (Cooling-Off Period)

4.1 Training Withdrawal (Digital Content + Services)
Consumers have a 14-day cooling-off period from the date of payment.
However, under Directive 2011/83/EU:
• For digital content supplied by immediate access, the right of withdrawal is lost once the student gives explicit consent to begin access and acknowledges loss of withdrawal rights.
• For services (training), if the student requests performance to begin within the 14-day period, they must pay a proportionate amount for services already performed.

“By enrolling, you request that the service and digital content begin immediately. You acknowledge that once access to the online content is granted, you lose your legal right of withdrawal for the digital portion of the training. The €500 enrollment deposit (see Section 12) is non-refundable except during this 14-day period, where a proportional refund may apply for unused services. If you withdraw within 14 days after payment, you will be refunded the proportional value of any unused service components, minus the full value of digital content already accessed and the non-refundable deposit if services have commenced.”

5. Refunds After 14 Days

After the 14-day cooling-off period:
• No refunds are provided for the training, including the €500 non-refundable enrollment deposit (see Section 12).
• This applies to both the digital and the in-person training components.
• Failure to attend the in-person portion does not grant entitlement to a refund.
This is fully aligned with Articles 9–16 of Directive 2011/83/EU on withdrawal and exceptions.

6. In-Person Attendance

Students must attend scheduled in-person hours.
If absent, students are responsible for arranging make-up hours at their own cost.
Non-attendance does not constitute grounds for a refund.

7. Access to the Private Online Community

7.1 Included Access
Enrolment automatically includes free access to the Academy’s private online community until the training’s fixed end date.

7.2 Optional Ongoing Membership
After the training ends:
• Continued community access is optional and costs €95 per year.
• This membership is billed annually.
• Consumers have a 14-day 100% money-back guarantee after each annual payment.

7.3 Cancellation Terms
After the 14-day period:
• No refunds are issued for the remaining months of the current membership year.
• Members may cancel any time and will retain access until the end of the paid year.
This complies with Article 16 regarding service contracts performed over time.

8. Additional Payments & Fees

No hidden charges or pre-ticked boxes are used.
All fees are presented clearly before purchase , including the €500 non-refundable enrollment deposit (see Section 12), in line with Articles 19–22 of Directive 2011/83/EU.

9. Delivery of Services and Digital Content

Digital access is delivered immediately upon payment.
In-person sessions are delivered on the dates provided.
We fulfil all obligations according to Article 18 on delivery of services.

10. Complaints & Customer Service

Customer support is provided at basic telecommunication cost as required by Article 21.
Complaints can be submitted by email and will be processed promptly.

11. Governing Law

These Terms are governed by applicable EU consumer law, including Directive 2011/83/EU.

12. Enrollment Deposit 

Upon inscription/enrollment into the Hybrid Yoga Teacher Training, a non-refundable deposit of €500 is required to secure your place in the program.
• This deposit is clearly disclosed and agreed to before completing enrollment.
• It is non-refundable under all circumstances after the 14-day cooling-off period (see Section 4).
• During the 14-day withdrawal period, the deposit may be refunded proportionally only if no services or digital content have been accessed/commenced.
• The deposit forms part of the total training fee and is applied toward the full program cost.
This ensures commitment to the program while fully complying with EU pre-contractual information requirements (Directive 2011/83/EU, Articles 6 and 8).
